City of Birmingham files lawsuit against short-term rental property and manager


The City of Birmingham announced it filed a lawsuit against a short-term rental property.

The city said its city attorney office named Infinity Investments LLC, the owner of 828 5th Street West, and Jabari Ayinde Mosley, believed to manage the property in the complaint.

The city asked the court to have the property declared a public nuisance.

The city claims the single-family dwelling has continued to experience illegal and criminal activity on multiple dates.

“We will not accept a property owner exposing residents and businesses to a continued threat against public safety,” City Attorney Nicole King said. “When violence and drugs threaten public safety, it’s important that the city steps in to disrupt the activity, hold criminals accountable, and make our neighborhoods safer for residents, businesses, and visitors.”

The lawsuit filed in Jefferson County Circuit Court claims Infinity Investments LLC and the property manager failed to screen short-term renters of the property.

The city said it has received and identified multiple complaints regarding the property and heard from residents and businesses who have expressed fear for their safety.

This action is part of the city’s broader effort, led by the Drug and Nuisance Abatement Team (DNAT), to hold property owners accountable for keeping their properties safe and crime-free. Residents are encouraged to report similar nuisance properties to the city attorney’s office.
